    By accessing and using the Idaho Health Data Exchange (IHDE) website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use immediately.

    2. Description of Services

    IHDE provides health information exchange services including but not limited to: the Clinical Portal, EHR integration services, roster-based data feeds, and related tools and technologies designed to facilitate the secure exchange of health information among authorized healthcare participants in Idaho.

    3. User Obligations

    Users of IHDE services agree to: use the services only for lawful purposes consistent with applicable healthcare regulations, maintain the confidentiality of login credentials and access tokens, report any suspected unauthorized access or security breaches immediately, and comply with all applicable HIPAA, HITECH, and Idaho state privacy regulations.

    4. Intellectual Property

    All content, trademarks, service marks, and logos displayed on this website are the property of IHDE or their respective owners. No material may be reproduced, distributed, or used for commercial purposes without prior written consent.

    5. Limitation of Liability

    IHDE provides health information exchange services as a conduit for data between healthcare organizations. IHDE does not provide medical advice, diagnosis, or treatment. Clinical decisions remain the sole responsibility of the treating healthcare provider. IHDE shall not be liable for any clinical outcomes resulting from the use or non-use of exchanged information.

    6. Governing Law

    These terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ada County, Idaho.

    7. Changes to Terms

    IHDE reserves the right to modify these terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of the services after changes constitutes acceptance of the revised terms.
